Full-time Counsel, Test Security

Position objective: The Counsel, Test Security represents ACT in test security (“TS”) related arbitration proceedings and provides advice regarding investigation and dispute resolution processes.

Typical work-related activities include:
Prepare TS related arbitration briefs and exhibits and manage arbitration matters
Analyze evidence in TS cases and recommend next steps
Assist in directing department staff in gathering, organizing, and analyzing TS-related information
Collaborate across ACT departments and with outside parties concerning TS policies, procedures, or investigations
Coordinate with officials in criminal investigations of test security breaches and test-related fraudulent activities
Communicate efficiently and effectively with examinees, their representatives, high school and college officials, forensics experts, ACT clients, and staff from other ACT departments during test score reviews and investigations
Present cases to the Test Security Review Panel
Conduct audits of ACT test sites
Conduct large-scale investigations into instances of potential test fraud, including onsite and telephonic interviews
Develop and maintain a current understanding of areas of the law related to TS, such as contracting, contracts with minors, arbitration, privacy, and state and federal legislation related to education and testing
Develop and maintain an understanding of new technologies that may impact TS and make recommendations to the TS team concerning tools and technologies to protect against potential TS threats
Regularly present updates to the TS team concerning case law, statutes, and developing technologies or practices that may impact TS
Assist with identifying, developing and implementing program and process improvements and metrics
Maintain security and confidentiality of corporate information and materials
Assist in directing department staff in the preparation of evidentiary letters, arbitration briefs, and other related matters
Communicate with and make presentations to ACT employees, management or clients

Minimum Qualifications
Education:
Doctor of Law (JD) and a current legal license required

Experience:
Minimum of three years of experience as a practicing attorney required
Experience collecting and analyzing research data preferred

Knowledge, Skills and Abilities:
Must have demonstrated competence in:
teaming and collaboration
computer usage and software, including word processing, spreadsheet, project management database, and Windows
managing and organizing work and personnel
determining logical solutions to complicated problems
setting specific goals and priorities
managing stress effectively
communicating through strong, organized writing and verbal skills
Ability to maintain a high level of confidentiality regarding corporate information
Superior ability to read and interpret written material
Ability to maintain a current legal license

Senior Manager, Test Security

COMPENSATION:
